These General Terms and Conditions apply to all offers and quotes from ArcAspen Network with respect to Services and are an integral part of every Agreement between ArcAspen Network and Customer.
Provisions or conditions imposed by the Customer that derogate from, or are not present in, these General Terms and Conditions, are only binding for ArcAspen Network if ArcAspen Network expressly accepts these in Writing.
The provider of services (the "Provider") is ArcAspen Network registered as M4ketech. Company ID: 2323493-4. The business is registered in the Trade Register in Finland.
The materials on ArcAspen.net are provided “as is.” ArcAspen Network disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. ArcAspen Network does not warrant the accuracy or reliability of materials on this site or linked sites.
Materials on this site may contain technical, typographical, or other errors. ArcAspen Network does not warrant that materials are accurate, complete, or current. ArcAspen Network may update materials at any time without notice and is not obligated to keep materials up to date.
ArcAspen Network and its suppliers are not liable for failure or delay resulting from causes beyond reasonable control (acts of God, natural disaster, war, terrorism, strikes, DDOS or other force majeure). Where a separate SLA applies to a service, the SLA terms govern to the extent of any conflict with these Terms.
To the maximum extent permitted by applicable law, ArcAspen Network and its suppliers are not liable for damages (including loss of data, profit, or business interruption) arising from use of or inability to use our services, even if ArcAspen Network was advised of the possibility of such damages.
By ordering you agree that refunds are provided only under this policy. Downtime caused by customer misconfiguration, upstream provider failures, or force majeure does not qualify for a refund. Refunds will not be granted for lack of technical knowledge or inability to configure services. Approved refunds are normally processed within seven (7) business days.
All refunds will be the net amount received after third-party processor fees (Stripe, PayPal, etc.) have been deducted. These processing fees are charged by the payment provider and cannot be refunded by ArcAspen Network.
All services must be paid in full and in advance. Invoices must be paid by the due date. If payment is not received within two (2) days after the due date, services will be suspended. If payment remains unpaid for three (3) days after the due date, services may be terminated and associated data permanently deleted. ArcAspen Network is not liable for any data loss resulting from suspension or termination for non-payment. A late fee of up to 10% may apply to active services that remain unpaid after suspension.
Customers must cancel recurring PayPal/processor subscriptions themselves where applicable. If subscription payments continue after cancellation, ArcAspen Network may, at our sole discretion, issue a refund for any overpayment. Such refunds are not guaranteed and will be evaluated case-by-case.
Refunds must be requested via our official support ticket. PayPal disputes or credit card chargebacks are not an acceptable substitute for our refund process. Initiating an external dispute or chargeback may result in immediate suspension or deletion of services. Dissatisfaction or misuse is not grounds for a chargeback, use the support process to resolve issues.
Under EU consumer law, digital services typically include a 14-day right of withdrawal. By purchasing and activating a digital service immediately, you expressly waive the statutory withdrawal right for that service once delivery begins. Dedicated servers are treated as B2B transactions and are excluded from withdrawal and refund rights unless otherwise agreed in writing.
Use of our services for unlawful or abusive activity is strictly prohibited. The following are expressly forbidden (including but not limited to):
Any activity that violates local, national, or international law may result in immediate suspension or termination of services. In cases where activity is abusive, causes immediate harm to the network, or threatens the security or availability of other customers, ArcAspen Network may suspend or terminate services without prior notice.
Excessive CPU, memory, disk I/O, or network usage that degrades service to co-located customers is prohibited. ArcAspen Network monitors resource usage and may apply mitigation measures (throttling, rate-limits, temporary port blocks, or suspension) where required to protect other customers.
ArcAspen Network reserves the right to intervene and take preventive actions to safeguard systems and customers. Where immediate action (including emergency suspension) is required to protect the network, such action may be taken without prior notice. We will provide follow-up details and remediation options as soon as practicable.
Services advertised as “unlimited” or “unmetered” remain subject to physical hardware and network constraints and to the terms of our separate Fair Use Policy. Extreme or abusive usage may result in removal of features, mitigation measures, or service termination.
Enforcement of fair use and bandwidth policies is at ArcAspen Network’s discretion, exercised reasonably. Customers will be notified where practicable; emergency protective measures may be applied immediately if the network or other customers are at risk.
These Terms are governed by and construed in accordance with the laws of Finland. You submit to the exclusive jurisdiction of the courts of Finland for any disputes arising under these Terms.
Threatening, harassing, or abusive behavior toward ArcAspen Network staff or other customers will not be tolerated and may result in immediate termination of services at our discretion.
ArcAspen Network may modify these Terms, policies, or any referenced agreement at any time, at our sole discretion. For material changes that affect customer rights, billing, or service operation, we will make reasonable efforts to notify affected customers (for example by posting in the client area and/or sending email to the account contact on file). Your continued use of ArcAspen Network services after the effective date of changes constitutes acceptance of the updated Terms. It is your responsibility to review the terms periodically, failure to review does not excuse compliance with the current Terms. The most recent version of these Terms will be available on our website.
